Fenton Athletic Association, Inc 2009 Baseball/Softball Car Raffle
Rules and Regulations
1. The FENTON ATHLETIC ASSOCIATION, INC. 2009 Baseball/Softball Car Raffle is conducted by FENTON ATHLETIC ASSOCIATION, INC. a not for profit 501C3 corporation organized under the laws of the State of Missouri. All proceeds, less expenses and prizes will benefit FENTON ATHLETIC ASSOCIATION, INC.
2. The purchase price of a FENTON ATHLETIC ASSOCIATION, INC. 2009 Baseball/Softball Car Raffle ticket is $5.00 each. If any tickets paid for with a check, and the check is dishonered by the bank or financial institution, the tickets paid for by that check will be declared invalid unless full payment is made in good funds prior to the drawing.
3. Purchasers of the FENTON ATHLETIC ASSOCIATION, INC. 2009 Baseball/Softball Car Raffle tickets must be 18 years of age or older and must qualify under Missouri law.
4. The raffle prizes shall be : Grand Prize – 2009 Chevrolet automobile or similar valued at approx. $15,000. 1st Prize $1000 ; 2nd Prize $500
5. Odds of winning will depend upon final number of tickets sold.
6. If fewer than 8,000 tickets are sold, FENTON ATHLETIC ASSOCIATION, INC. reserves the right in its absolute discretion, to substitute the prizes listed for a cash prize of 50% of the gross sales revenue, less expenses, between the holders of the winning tickets. The prizes would then be: Grand Prize – 35% of gross sales, less expenses.1st Prize - 10% of gross sales, less expenses; and 2nd Prize - 5 % of gross sales, less expenses.
7. The winners will be determined by a random drawing conducted by an independant accounting firm. The drawing will be held on June 27, 2009 at the FENTON ATHLETIC ASSOCIATION, INC. building (945 Larkin Williams Rd. Fenton, MO 63026 at 8:00pm CDT.) If for any reason the drawing could not be held at the stated location and time, the change would be posted on the FENTON ATHLETIC ASSOCIATION, INC. web site (www.fentonathletic.com) with a date not to be any later than 10 days from originally scheduled.
8. Winners will assume and be responsible for payment of the required federal withholding tax, if any, all licensing, registration, and all other fees, and local, state and federal taxes, including without limitation, all applicable sales, use, luxury and income taxes. FENTON ATHLETIC ASSOCIATION, INC. specifically disclaims all express or implied warranties, as to description, quality, fitness for any particular purpose, safety, useability, or conformity with any applicable laws or regulations, including OSHA, or any other matter in conjunction with this raffle.
9. If the car is awarded, the winners may NOT substitute the car for cash.
10. Ticket holders need NOT be present to win. Winners will be notified by telephone and certified mail as obtained from the ticket stub within 72 hours of the drawing.
11. Winner(s) have 30 days to claim prizes, or forfeits all claims thereto. Successive alternate winners will be drawn by the independent accounting firm in case the winner(s) do not claim their prize within the 30 days or is otherwise ineligible.
12. Purchasers of tickets assume all responsibility for ticket stubs to be returned to Henderson Fields located at 945 Larkin Williams Road prior to drawing date.
13. The staff, trustees, and board members of FENTON ATHLETIC ASSOCIATION, INC., at their discretion, may participate in the FENTON ATHLETIC ASSOCIATION, INC. 2009 Baseball/Softball Car Raffle.
14. The decisions of the FENTON ATHLETIC ASSOCIATION, INC. Executive Board shall be final on all matters concerning the FENTON ATHLETIC ASSOCIATION, INC. 2009 Baseball/Softball Car Raffle.
15. All winners will be required to sign and return an Affidavit of Eligibility, a Liability Release, and where permitted, a Publicity Release, as part of the prize claim procedure. In the event of non-compliance with these requirements, winner may be disqulified and an alternate winner selected. FENTON ATHLETIC ASSOCIATION, INC. reserves the right, in its sole discretion to cancel, terminate, or suspend this raffle should unauthorized human intervention or other causes beyond the control of FENTON ATHLETIC ASSOCIATION, INC., corrupt or impair the administration, security, fairness, or proper play of the raffle. In such event, the winners for the prizes will be selected by random drawing from all eligible tickets received up to the time of such cancellation, termination or suspension.
16. By participating, ticket holders agree to release, indemnify and save FENTON ATHLETIC ASSOCIATION, INC., advertising/promotional agencies, vendors, and the employees, directors, board members, and agents associated with this raffle harmless, from any claims, suits, actions, costs, and expenses, including attorney’s fees, arising out of or in connection with this raffle.
17. For a list of prize winners, mail a self addressed, stamped envelope after September 1, 2009 and prior to February 1, 2009 to FENTON ATHLETIC ASSOCIATION, INC. / Raffle List BB/SB, 945 Larkin Williams Road, Fenton, MO 63026.
General Contitions: Limit one prize per person/family household. By purchasing a ticket, purchasers accept and agree to the official rules and regulations and the decisions of FENTON ATHLETIC ASSOCIATION, which are final and binding in all respects. The depiction of the 2009 Chevrolet automobile shown in any promotional materials may not reflect the actual vehicle delivered to the grand prize winner.
